Usage Policy

Article 1 - General provisions

These conditions (hereinafter "Conditions") apply to the use of the website www.argenux.com (also mobile sites), including elements and applications, created or owned by iContest, a company incorporated under Moroccan law.

The term User refers to any person who accesses the website www.argenux.com and who use it.

By using the website www.argenux.com , the User fully and unconditionally accepts the Conditions applicable thereto and undertakes to comply with them.

If he refuses the Conditions, he is required to refrain from any use of the website www.argenux.com or related services.

In the event of non-compliance with the Conditions, Argenux, i.e. iContest, reserves the right to refuse access to the Argenux platform, without prejudice to its right to demand compensation from any third party for all direct and indirect damages that may result from this non-compliance.

iContest reserves the right to partially or completely update the Terms of Use at any time. The user will be informed via an email sent to his email address.

If the visitor does not have an account, it is advisable to regularly consult the Terms of Use in order to always be informed of the most recent version.

Article 2 - Use of the Argenux platform

The use of the Argenux platform is in principle free and free of charge. To use it, the User must register, provide certain data and a password.

In case of refusal by the User, the use of the Argenux platform will not be possible. Except the public pages of the platform.

Article 3 - Copyright and rights of the producer of a database

All copyrights, trademarks, patents, intellectual property rights and other proprietary rights applicable to the Argenux Platform shall at all times belong to iContest.

The Argenux platform constitutes both a copyrighted work and databases over which iContest holds the copyright and producer rights.

The texts, designs, drawings, photos, films, graphics and other elements of the Sites are protected by copyright.

The copying, adaptation, modification, translation, arrangement, public communication, rental or any other form of exploitation of all or part of the Sites, in any form whatsoever and by any means whatsoever, in particular electronic, printable or otherwise, is strictly prohibited without the prior written permission of iContest.

Any violation of these rights is subject to legal proceedings.

Article 4 - Trademarks and trade names

The names, logos and other signs used on the Argenux platform (in particular the iContest logos and names) are legally protected trademarks and/or trade names.

Any use of these or similar signs is strictly prohibited without the prior written permission of iContest.

Article 5 - Liability

iContest will make every effort to ensure the proper functioning of the Argenux platform.

Except in the event of intentional breach and/or mandatory legal provisions to the contrary, iContest declines all liability for any loss or damage (direct, indirect, material, immaterial, etc.) resulting from:

iContest also has the right to refuse access to the Argenux platform or to terminate it at any time and without prior warning.

In cases where iContest is held liable, the amicable solution takes precedence.

Article 6 - Respect for privacy – processing of personal data

iContest and the User undertake to comply with the regulations in force applicable to the processing of personal data and, in particular, the provisions of Law 09-08 relating to the protection of individuals with regard to the processing of personal data in Morocco.

The Argenux platform may include links to other websites. To the extent that iContest cannot control these sites, it cannot be held responsible for the provision of these sites. It cannot bear any responsibility for the content, advertisements, products, services or any other material available on or from these sites.

Furthermore, iContest shall not be held liable for any damages or losses, proven or alleged, resulting from or in connection with the use of or reliance on the content, goods or services available on these sites.

Article 8 - Cookies

iContest uses Cookies to provide functionality and a good experience on the Argenux platform.

Article 9 - User Contribution

By participating in the Contests, the User may upload video, audio, text, photo or other type of file requested (hereinafter "Contributions").

Once the User uploads the file of his participation in a competition, this uploaded file becomes an intellectual property of iContest, in the event of winning the competition and even in the event of losing.

If the User does not accept this article, he must not use our platform. The use of our Argenux platform and, in particular, participation in a competition represents the User's consent that the uploaded files are an intellectual property of iContest.

The user must never participate with content that is already protected by intellectual property rights.

Article 10 - Jurisdiction and applicable law

Moroccan law applies to the Argenux platform and the national courts have sole jurisdiction in the event of disputes arising from the use of the platform.
